Any peace officer, foreign service or inspector of the department or any other law enforcement officer of that state or municipality has the right to apply for the issuance of a motorcycle driver`s licence in accordance with section 55-8-101 and to order the arrest of any person who so contravenes this section. (d) The Director of the Regulatory Bodies Division or the duly authorized representatives of the Director may, at any reasonable time, review and copy the relevant books, accounts, documents or records to determine whether a licensee has properly managed and disbursed funds from escrow accounts or escrows required under this Part. In the event of a refusal of access granted in this paragraph (d), the Director or the authorized representatives of the Director may file the actions for disobedience provided for in Article 4-5-311 (b) against a legal obligation to inform the Authority. Refusal is also grounds for the Commission to suspend or revoke a licence. Licensee`s license will be automatically revoked sixty (60) days after Licensee`s conviction, unless Licensee requests a hearing in writing from the Board during such sixty-day period.
Following such consultations under this section, the Commission may, at its discretion, impose on the licensee any penalty permitted under this chapter.
